  1. Conclusion of the contract

    • On the semprearte.com website you can conclude contracts in accordance with these regulations and Polish and EU law.

    • The contracting party is the company:

    • Clicking the "Confirm Order" button constitutes a binding order for the goods in your shopping cart. Immediately after your order is confirmed, we will send you a confirmation email. Upon receipt of the order confirmation email, a binding contract is concluded.

  2. Delivery of goods

    • You can check the delivery methods at https://semprearte.com/pages/dostawa

    • The order will be shipped after you have paid the full price for the products, including delivery costs, unless you have selected the "Cash on Delivery" method or we cover the delivery costs.

    • Orders are shipped within Poland and the European Union.

    • The delivery time given in days refers to working days – from Monday to Friday inclusive – excluding public holidays.

    • The SempreArte Store is not liable for non-delivery of goods if the Customer provided an incorrect address or failed to collect the goods without prior notice of the impossibility of collection. In justified cases, the SempreArte Store may refund the Customer the amount paid, less PLN 30, which represents the cost of returning the product and re-stocking it.

  3. Shipping costs and product prices

    • Delivery costs are available at https://semprearte.com/pages/dostawa

    • Promotions, including promotional codes, cannot be combined, which means that only one promotional code can be used per purchase.

    • Product prices are gross, meaning they include VAT applicable at the time of transaction. Products in the order remain the property of the store owner until the full purchase price is paid.

  4. Payments

    • We offer the following payment methods: card payments, PayU fast transfers, PayU Blik, PayPo and Twisto deferred payments, bank transfers, and cash on delivery. All transaction costs are your responsibility.

    • If the delivery address is outside Poland, we reserve the right not to offer certain payment options.

    • Payment by bank transfer can be processed within 3 business days. If payment is not received within this timeframe, the order may be automatically canceled.

  5. Withdrawal from the contract

    • Under Polish law, you have 14 days from the date of delivery to withdraw from the contract without giving a reason. To withdraw from the contract, please send a clear statement to Rogów 45, 22-425 Rogów, or by email to info@semprearte.com. You can use our form to do so, although it is not mandatory.

    • If you withdraw from the contract, we are obliged to immediately, but no later than 14 days from the date we receive notification of withdrawal, refund all payments received from you, including delivery costs (excluding any additional costs that may arise from your choosing a delivery method other than the least expensive standard delivery method offered by us). Within 14 days of sending the notice of withdrawal, you are obliged to return the goods referred to in the notice at your own expense.

    • Instructions and the address to which the product should be returned will be provided after the buyer has notified the customer of their wish to return or exchange the product.

    • It is not possible to return the product to a parcel locker.

    • SempreArte may withhold the refund of the payment received from you until it receives the item back or the Consumer provides proof of having sent it back, whichever occurs first.

    • The refund will be made via the same transaction channel that you used to pay for the order, unless we explicitly agree with you on a different refund channel.

    • Returned goods should be in perfect condition, with their original labels and packaging, and include a receipt or other proof of purchase. When returning goods, please carefully secure the package to prevent damage or destruction during transport.

    • You are responsible for any diminished value of the item resulting from handling it beyond what is necessary to establish its nature, characteristics, and functioning. You should only handle and inspect the goods in the same way you would in a physical store.

  6. Voluntary right to return goods within 30 days of receipt

    • The SempreArte store offers you the voluntary right to return goods within 30 days of receipt, without prejudice to your statutory right of withdrawal. This allows you to return the goods after 14 days.

    • The 30-day period for the voluntary right to return is counted from the date the customer receives the goods.

    • The condition for exercising your voluntary right of return is that you have not used the product, have only tried it on as if in a clothing store, and that you return the goods complete, in their original condition, undamaged, and in their original packaging. Until the statutory right of withdrawal expires, only the statutory conditions related to this right apply. Your voluntary right of return does not in any way limit your statutory rights of withdrawal and return, which remain unaffected.

  7. Store Card – STORE CREDIT

    • GENERAL PROVISIONS

      • These regulations define the rules for returning products purchased in the SempreArte store in exchange for store credit.

      • Store credit is funds granted to the Customer that can only be used for purchases in the SempreArte.com store .

    • Store Card - STORE CREDIT

      • Once the return is accepted, the Customer receives a store credit equal to the price of the purchased product.

      • During the promotion period, until further notice, the customer can receive an additional 5% of the original refund amount.

      • Store credit is valid for 3 years from the date it is issued.

      • The credit can be used to purchase any products available in the SempreArte.com store .

      • Store credit cannot be exchanged for cash, gift cards or other forms of payment or funds.

      • If the order value exceeds the credit value, the difference must be paid using the standard payment method.

    • RETURN PROCEDURE

      • The customer expresses their wish to make a return to the Store Card via [return form/email contact/returns page].

      • After receiving consent, the Customer returns the product to the returns address provided in the instructions.

      • Return shipping costs are borne by the customer.

      • Once your return is received and verified, store credit will be issued within 5 business days.

    • “Extra 5%” promotion when redeeming on your Store Card

      • The promotion only covers refunds from the standard payment method to the Store Card.

      • If a product purchased with funds from a Store Card is returned and the promotion has already been applied, the promotion will not apply again.

    • EXCLUSIONS

      • Products that are damaged, used or missing their original packaging are not eligible for return.

      • Personalised or made-to-order products are not eligible for the “Extra 5%” promotion.

  8. Liability for product defects

    • The Semprearte store is committed to providing you with products free from defects.

    • We are legally liable for all defects in products sold on the website semprearte.com under the warranty for defects arising from Article 556 et seq.

  9. Complaints

    • Complaints regarding products sold on semprearte.com should be directed to info@semprearte.com. You may use our complaints form to submit your complaint, but this is not mandatory.

    • In some complaints, we may ask you to send photos of the product being complained about, however we encourage you to attach photos whenever you complain about a product.

    • We will consider your complaint within 14 days of submitting a complete complaint.

    • We would like to draw your attention to the fact that the following product damages are not subject to complaint:

      • natural wear and tear of the product;

      • mechanical damage (abrasion, tearing, tearing or scratching, removal of decorations, zippers, rubber, etc.) occurring during your use of the products, and damage resulting from lack of or improper maintenance;

      • damage resulting from use of the product contrary to its intended purpose;

      • discoloration of clothing caused by products made with a naturally colored lining or made of natural leather;

  10. Newsletter and loyalty card

    • As part of the Website's functionality, Semprearte offers a Newsletter service, which allows Semprearte to send marketing information about Semprearte's activities and the products and services it offers, including, in particular, trends, news, special offers, and promotions, to the email address provided by the Customer when signing up for the Newsletter, in accordance with the rules set out in the section below. Information sent as part of the Newsletter may be tailored to the Customer's profile, in particular to the Customer's purchasing interests.

    • Customers can subscribe to the Newsletter by providing their email address in the Newsletter subscription form. By providing their email address in the Newsletter subscription form, they consent to receiving the information referred to in the section above from Semprearte electronically.

    • Subscription to the Newsletter and use of the Newsletter service (after subscription) is free of charge and voluntary.

    • The Newsletter service is provided for an indefinite period. The Customer may unsubscribe from the Newsletter at any time and without providing a reason (unsubscribe from the Newsletter). The Customer may unsubscribe from the Newsletter at their own discretion via the unsubscribe link located at the end of each Newsletter or by contacting Semprearte using the contact details in the Contact tab. To complete the unsubscription, the Customer must confirm the unsubscription. A request to confirm the unsubscription will be sent to the email address to which the Customer received the Newsletter. Only after the Customer confirms their wish to unsubscribe will their email address be removed from the Semprearte newsletter mailing list, and the Newsletter will no longer be sent to the Customer. After unsubscribing from the Newsletter, the Customer may continue to receive the Newsletter for a certain period until Semprearte technically processes the unsubscription; however, this period will not exceed 30 days.

  11. Gift Card

    • The Gift Card can only be purchased via the website www.semprearte.com .

    • The card is non-refundable unless generally applicable legal provisions, in particular consumer protection provisions, provide otherwise.

    • The card cannot be exchanged for cash.

    • The provisions of the Act of 19 August 2011 on payment services do not apply to Cards.

    • If the price of the goods selected by the Customer exceeds the amount of the Balance, the Customer is obliged and entitled to pay the missing part of the price in a manner accepted in the Store.

    • If the price of the goods selected by the Customer is lower than the Balance amount, the Issuer is not obliged to return the Balance remaining on the Card to the Customer or Purchaser and therefore the Balance unused by the Customer remains on the Card.

    • The Purchaser is fully responsible for making the Card available to other persons and is therefore obliged to take all necessary measures to prevent unauthorized persons from obtaining possession of the Card.

    • In the event of withdrawal from the contract for the sale of goods paid for with the Card, the funds are returned to the Customer on the Card also by issuing a new Card.

    • The Issuer reserves the right to change the Regulations, but such changes do not affect the rights of Purchasers of Cards already issued and Customers using such Cards.

  12. Loyalty Card

    • The SempreArte loyalty card is awarded to customers of the SempreArte online store for spending a total of PLN 2,000.

    • The card cannot be topped up.

    • The card is assigned to the email address from which purchases were made for a total amount of PLN 2,000.

    • The card works after entering the discount code provided on the card when placing the order.

    • The card is valid indefinitely.

    • Possession of the card entitles you to a permanent 10% discount.

    • The discount is valid with pre-sales and regular promotions from the “Promotions” section.

    • The discount cannot be combined with occasional promotions in the form of codes - only one code can be entered in the basket.

  13. Recommendations and Opinions

    • Semprearte guarantees Customers who have purchased or own a product from semprearte.com the opportunity to post Reviews.

    • Detailed rules and conditions for posting Opinions by Customers are regulated in the Separate Regulations regarding posting Opinions on the Website, available here .

  14. Other information.

    • None of the provisions of these Terms and Conditions are intended to violate the Buyer's rights, nor may they be interpreted as such. In the event of any inconsistency between any part of these Terms and Conditions and applicable law, SempreArte declares unconditional compliance with and application of such law in place of the challenged provision of these Terms and Conditions.
