  1. Conclusion of the contract
    • On the semprearte.com website you can conclude contracts in accordance with these regulations and Polish and EU law.
    • The contracting party is the company:

    • Clicking the "Confirm order" button is equivalent to placing a binding order for the goods in your basket. Immediately after confirming the order, we will send you a confirmation by email. Upon receipt of the order confirmation message, a binding contract is concluded.

 

  1. Delivery of goods
    • You can check the delivery methods on the website https://semprearte.com/pages/dostawa
    • The order will be shipped after you have paid the full price for the products including the shipping costs, unless you have chosen the "Cash on Delivery" method or we cover the shipping costs.
    • Orders are fulfilled within Poland and the European Union.
    • The delivery time given in days refers to working days – from Monday to Friday inclusive – excluding public holidays.
    • The SempreArte Store is excluded from liability for non-delivery of goods in a situation where the Customer has provided an incorrect address or has not collected the goods beforehand without informing about the impossibility of collection. In justified cases, the SempreArte Store may return the paid amount to the Customer reduced by PLN 30, which is the cost of returning and re-accepting the product to the Warehouse .

 

  1. Shipping costs and product prices
    • Shipping costs are available at https://semprearte.com/pages/dostawa
    • Promotions including promotional codes cannot be combined, which means that only one promotional code can be used per purchase.
    • Product prices are gross prices, which means they include VAT applicable at the time of the transaction. The products in the order are the property of the store owner until the full sales price is paid.

 

  1. Payments
    • We have provided the following forms of payment for you: card payment, PayU fast transfer, Blik PayU, PayPo and Twisto deferred payment, bank transfer, cash on delivery. All financial transaction costs are on your side.
    • If the delivery address is outside Poland, we reserve the right not to offer certain payment options.
    • The waiting time for payment by bank transfer is 3 business days. If payment is not received within this time, the order may be automatically canceled.

 

  1. Withdrawal from the contract
    • According to Polish law, you have 14 days from the date of delivery of the goods to withdraw from the contract without giving a reason. To withdraw from the contract, please send an unequivocal statement to Rogów 45 , 22-425 Rogów, or by e-mail info@semprearte.com . For this purpose, you can use our form, although it is not obligatory.
    • In the event of withdrawal from the contract, we are obliged to return all payments received from you immediately, but no later than within 14 days from the date of receipt of the notification of withdrawal from the contract, including delivery costs (with the exception of additional costs that may arise in connection with your choice of a delivery method other than the cheapest standard delivery method offered by us). Within 14 days of sending the declaration of withdrawal from the contract, you are obliged to return the goods referred to in the declaration at your own expense.
    • Instructions and the address to which the product should be returned will be provided after the buyer has notified us of their wish to return or exchange the product.

    • It is not possible to return the product to a parcel locker.
    • SempreArte may withhold the refund of the payment received from you until it receives the item back or until the Consumer provides proof of sending it back, depending on which event occurs first.
    • The refund will be made via the same transaction channel that you used to pay for the order, unless we expressly agree with you on a different refund channel.
    • The returned goods should be in perfect condition, originally labeled and packaged, and include a receipt or other type of proof of purchase. In the case of shipping the returned goods, we kindly ask you to carefully secure the package so that it is not damaged or destroyed during transport.
    • You are responsible for any diminished value of the item resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the item. You should only handle and inspect the goods in the same way as you would in a brick-and-mortar store.

 

  1. Voluntary right to return goods within 30 days of receipt
    • The SempreArte store offers you the voluntary right to return the goods within 30 days of receipt, without prejudice to your statutory right to withdraw from the contract. Thanks to this, you will be able to return the goods after 14 days .
    • The 30-day period for the voluntary return right is counted from the date the customer receives the goods.
    • The condition for exercising the voluntary right of return is that you have not used the product, you have only tried it on as in a clothing store, and you return the goods complete, in their original condition, without damage and in their original packaging. Until the statutory right of withdrawal expires, only the statutory conditions related to this right apply. The voluntary right of return does not in any way limit your statutory rights of withdrawal and return of the product, which remain unaffected.
    • Products other than women's handbags are not subject to the voluntary 30-day return policy.

 

  1. Liability for product defects
    • The Semprearte store is committed to providing you with products free from defects.
    • We are legally liable for all defects in products sold on the website semprearte.com under the warranty for defects pursuant to Article 556 et seq .

 

  1. Complaints
    • Complaints regarding products sold on semprearte.com should be sent to info@semprearte.com . You can use our complaint form to file a complaint, but it is not obligatory.
    • In some complaints we may ask you to send photos of the product being complained about, however we encourage you to attach photos whenever you complain about a product.
    • We will consider your complaint within 14 days of submitting a complete complaint form.
    • We would like to draw your attention to the fact that the following product damages are not subject to complaint:
      • natural wear and tear of the product;
      • replaceable parts , e.g. locks, carabiners, straps;
      • mechanical damage (abrasion, tearing, tearing or scratching, removal of decorations, zippers, rubber, etc.) incurred during your use of the products, and damage resulting from lack of or improper maintenance;
      • damage resulting from use of the product other than for its intended purpose;
      • discoloration of clothing caused by products made on a naturally colored lining or made of natural leather;
      • comfort of footwear, water-tightness of footwear (unless the description states that the product is waterproof).
    • We would like to inform you that there are many out-of-court methods of resolving disputes and we encourage you to use out-of-court methods of resolving complaints and pursuing claims in accordance with the Online Dispute Resolution procedure developed by the European Commission, available on the website: https://webgate.ec.europa.eu/odr/main/?event=main.home.show


  2. Newsletter and loyalty card
    • Semprearte, as part of the functionality of the Service, offers a Newsletter service consisting of sending by Semprearte information of a marketing nature about Semprearte's activities and products and services offered by Semprearte, including in particular trends, news, special offers and promotions to the e-mail address provided by the Customer when signing up for the Newsletter in accordance with the principles indicated in the point below. Information sent as part of the Newsletter may be tailored to the Customer's profile, in particular to the Customer's shopping interests.
    • The Client may subscribe to the Newsletter by leaving an e-mail address in the Newsletter subscription form. Leaving an e-mail address in the Newsletter subscription form is tantamount to consenting to receiving information from Semprearte electronically, as referred to in the point above.
    • Subscription to the Newsletter and use of the Newsletter service (after subscription) is free of charge and voluntary.
    • The Newsletter service is provided for an indefinite period. The Customer may at any time and without giving any reason cancel the Newsletter subscription (Newsletter unsubscription). The Customer may unsubscribe from the Newsletter at their own discretion via the unsubscribe link located at the end of each Newsletter or by contacting Semprearte using the contact details from the Contact tab. In order to finalize the unsubscription of the Newsletter, the Customer must confirm the unsubscription. A request to confirm the unsubscription of the Newsletter will be sent to the e-mail address to which the Customer received the Newsletter. Only after confirming the desire to unsubscribe from the Newsletter, the Customer's e-mail address is removed from the Semprearte newsletter mailing list and the Newsletter is no longer sent to the Customer. After unsubscribing from the Newsletter, until the technical processing of the unsubscription by Semprearte, the Customer may still receive the Newsletter for a certain period, however, in no case will this period be longer than 30 days.
  • Gift Card and Loyalty Card
    • The Gift Card can only be purchased via the website www.semprearte.com.
    • The card is non-refundable unless generally applicable legal provisions, in particular consumer protection provisions, provide otherwise.
    • The card cannot be exchanged for cash.
    • The provisions of the Act of 19 August 2011 on payment services do not apply to Cards.
    • If the price of the goods selected by the Customer exceeds the amount of the Balance, the Customer is obliged and entitled to pay the missing part of the price in a manner accepted in the Store.
    • If the price of the goods selected by the Customer is lower than the Balance amount, the Issuer is not obliged to return the Balance remaining on the Card to the Customer or Purchaser and thus the Balance unused by the Customer remains on the Card.
    • The Purchaser is fully responsible for making the Card available to other persons and is therefore obliged to make every effort to prevent unauthorised persons from obtaining possession of the Card.
    • In the event of withdrawal from the contract for the sale of goods paid for with the Card, the funds are returned to the Customer on the Card also by issuing a new Card.
    • The Issuer reserves the right to change the Regulations, but such changes do not affect the rights of Purchasers of Cards already issued and Customers using such Cards.

    • The SempreArte loyalty card is awarded to customers of the SempreArte online store for spending a total of PLN 2,000.
    • The card cannot be topped up.
    • The card is assigned to the email address from which purchases were made for a total amount of PLN 2,000.
    • The card works after entering the discount code provided on the card when placing the order.
    • The card has an indefinite validity.
    • Possession of the card entitles you to a permanent 10% discount.
    • The discount is valid with pre-sale and permanent promotions from the “Promotions” section.
    • The discount cannot be combined with occasional promotions that operate in the form of codes - only one code can be entered in the basket.

     10. Recommendations and Opinions

    • Semprearte guarantees Customers who have purchased or own a product from the semprearte.com website the ability to post Reviews.

    10. Other information.
      • No provision of these regulations is intended to violate the rights of the Buyer. Nor can it be interpreted in this way . In in the event of any non-compliance of any part of the regulations with applicable law SempreArte declares unconditional submission to and application of this law in place of the disputed provision of the regulations.
